2026 will bring many regulatory changes for the retail sector in France. The rules regarding proof of compliance for point-of-sale systems were first tightened and then relaxed again. In addition, the reform on electronic invoicing has been in effect since September 1, 2026. For retailers and POS providers, this is primarily a matter of maintaining a clear overview: Which obligations apply at the register, which apply to accounting, and where do they overlap in day-to-day operations?

In France, two separate sets of regulations apply to commerce in parallel:
Legally, the two are not related. In business, however, they involve the same systems and the same data. That is why it is worth planning them together.
Since 2018, businesses subject to value-added tax that process payments from private customers via a point-of-sale system must comply with ISCA requirements. ISCA stands for the immutability, security, retention, and archiving of transaction data. For retailers, this means that every cash register, every mobile device, and every system variant must meet these requirements.

Valid documentation must be available for every point-of-sale system in use. Since the passage of the 2026 Finance Act, there have once again been two ways to do this:
Regardless of whether certification or a manufacturer's certificate is provided, efsta assists software providers in implementing French requirements in compliance with the law.
For in-house software and customizable software, external certification remains the appropriate approach. If proof is missing during an inspection, a fine of 7,500 euros per point-of-sale system may be imposed.

As of September 1, 2026, all businesses subject to value-added tax in France must be able to receive e-invoices via an accredited platform. This also applies to merchants who sell almost exclusively to end customers. Large companies and mid-sized enterprises (ETIs) must also issue e-invoices and report their transaction data. Small and medium-sized enterprises (SMEs) will follow starting September 1, 2027.
